SYNOPSIS: REASONS FOR THE DECISION: The National Classification Code (the Code)
states in the Film Table that: In the Classification Board's view under Section 1(a) of the Film Table in the Classification Act this film deals with matters of sex in a way that offends against the Under Part 2 of the Films Table of the National Classification Code concerning films containing consensual sexually explicit activity, "fetishes such as.....spanking are not permitted." In the Board's opinion a sequence commencing at 11mins and lasting until 14mins in which Pierre Woodman engages in sexual activity with a woman contains "fetishes such as.....spanking" as the contact of his hand with her buttocks during sex is at a level which goes beyond a mere slap and is clearly done in order to elicit sexual gratification for him. In one consecutive session during this sequence he spanks her thirteen times, in another, four times. In the Boards opinion this clearly indicates a fetish "such as spanking" and as such warrants an "RC" classification. *** In early 2001, AXIS applied to have this, and several other decisions reviewed. Despite the applications being outside the normal time provision, it was hoped that the Review Board would agree to the reviews. AXIS explained the reason for the PRIVATE SUPERFUCKERS 07 delay as: This title was refused during the lengthy process in establishing benchmarks for what represented a fetish such as spanking. When the board made their definitions, the scene of a male and female engaged in consensual sex where some slaps to the ass were made during sex was easily housed under their new definitions of permissible hand contact, not as previously recorded in the Refused Classification category as a fetish such as spanking. This film was delayed in its application for appeal during the 6 weeks AXIS was waiting for the review board to return their verdict on the original set of appeals. The Classification Review Board were unconvinced, and refused to allow
a review. Their reasons were: A revised print has never been submitted.
